Terms of Service

Acceptance of terms

By accessing WatchScope and using our services, you agree to be bound by these Terms of Service. If you do not accept these terms, you must not use the service. WatchScope is intended exclusively for professional use (B2B). The service is not designed for, and may not be used by, consumers. Consumer protection laws, including any statutory cancellation or cooling-off rights that apply solely to consumer contracts, are expressly excluded to the fullest extent permitted by applicable law.

Service description

WatchScope is a SaaS security monitoring platform designed for web agencies and IT professionals. It enables monitoring of client domains (SSL, DNS, email, reputation, subdomains, technologies), generating branded reports, and receiving real-time alerts. WatchScope is a preventive, indicative tool. It does not constitute an exhaustive or certified security audit, and its results should not be relied upon as a substitute for professional security assessment.

Accounts and access

Access to WatchScope is subject to validation by the WatchScope team and, thereafter, subscription to an active plan. You are responsible for maintaining the confidentiality of your credentials and for all activity performed under your account. You must notify us immediately at contact@watchscope.io of any suspected unauthorised access or security breach relating to your account.

Billing and payments

Subscriptions are billed monthly in advance. Payment is made via Stripe. In case of non-payment, the service will be suspended after 7 days. No refunds are given for started periods, unless otherwise required by law. If you do not accept changes to these Terms, you may terminate your subscription without penalty before the effective date of the new conditions.

Acceptable use

Domain authorisation — By adding any domain to WatchScope, you expressly declare that you are duly authorised to do so, whether as the registered owner of the domain or as a mandated representative acting on behalf of the domain owner. You assume sole and full legal responsibility for ensuring that each scan performed through the platform is lawful and explicitly authorised by the relevant domain owner. WatchScope expressly disclaims any liability for scans performed without proper authorisation; any civil, administrative or criminal consequences arising from such unauthorised use shall be borne exclusively by you. You further agree not to: • Use the service for illegal, fraudulent or unauthorised purposes • Deliberately overload, abuse or disrupt the platform infrastructure • Submit automated or excessive queries that exceed normal operational use • Use the platform as an offensive security or attack tool against any target • Attempt to bypass, circumvent or otherwise defeat rate limits, access controls or security protections • Probe, scan or test the vulnerability of the WatchScope platform itself • Resell or sublicense direct platform access without prior written authorisation • Use the service for spam, malware distribution or other malicious activities

Intellectual property

WatchScope and all its components — including but not limited to source code, design system, brand identity, algorithms, and generated report templates — are the exclusive intellectual property of WatchScope. Use of the service does not grant you any ownership rights, licences or other entitlements over these elements beyond what is strictly necessary to use the service as intended. Security reports generated through the platform on behalf of your clients belong to you and may be delivered to those clients subject to the terms applicable to your plan.

White-label and reselling

Subscribers on the Premium plan are granted a limited, personal, non-exclusive, non-sublicensable licence to present WatchScope-generated reports under their own brand when delivering them directly to their own end clients. This white-label licence is strictly limited to that purpose. It does not permit redistribution, sublicensing, further transfer or commercial exploitation beyond direct client delivery. The licence is automatically and immediately revoked upon termination of the subscription or downgrade to a plan that does not include white-label functionality. Direct resale of access to the WatchScope platform — i.e. providing third parties with login credentials or API access to the service — remains strictly prohibited unless expressly authorised in a separate written reseller agreement with WatchScope.

Aggregated and anonymised data

WatchScope may collect, process and use aggregated and fully anonymised data derived from platform activity — such as scan volumes, detection rates, module usage patterns and general infrastructure trends — for the purposes of internal analytics, product research and service improvement. Such aggregated data contains no personally identifiable information and cannot be used to identify any individual user, organisation or monitored domain. This use of anonymised data does not require separate consent and does not affect your rights under the Privacy Policy.

Force majeure

WatchScope shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to: natural disasters, government actions, war or civil unrest, power or telecommunications failures, critical infrastructure outages, cyberattacks or distributed denial-of-service attacks targeting WatchScope or its hosting providers, or any other event that could not have been reasonably foreseen or prevented. In such circumstances, WatchScope will use commercially reasonable efforts to restore the service as quickly as practicable and will communicate any significant outage to affected users.

Data and privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the service, you acknowledge and consent to such processing. You remain the owner of your data and may request its export or deletion at any time; such requests will be fulfilled within 30 working days. WatchScope engages sub-processors to support service delivery — including Stripe for payment processing and OVH for European infrastructure hosting. Limitation of liability

WatchScope is a preventive, indicative monitoring tool. It does not constitute an exhaustive or certified security audit, and no warranty is given as to the completeness, accuracy or timeliness of any scan result. WatchScope shall not be held liable for any security incident, data breach, or damage occurring on a monitored domain, regardless of whether the relevant vulnerability was detected, reported or not reported by the platform. No uptime SLA is guaranteed. The service is provided on a commercially reasonable best-effort basis. Scheduled or unscheduled maintenance and upgrades may cause temporary interruptions; WatchScope will make reasonable efforts to give advance notice of planned downtime where practicable. To the maximum extent permitted by applicable law: • WatchScope’s total aggregate liability for any claim arising out of or relating to these Terms or the service is strictly limited to the total fees actually paid by you in the three (3) calendar months immediately preceding the event giving rise to the claim. • WatchScope shall not be liable for any indirect, consequential, incidental, special or exemplary damages of any kind, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunity, reputational damage or cost of substitute services, even if WatchScope has been advised of the possibility of such damages.

Termination

You may cancel your subscription at any time from your account area. Cancellation takes effect at the end of the current billing period; no refund is issued for any remaining portion of the paid period. In the event of a material breach of these Terms, WatchScope will send a formal written notice by email and allow 48 hours to remedy the breach before suspending or terminating the account. This notice and cure period does not apply to serious violations — including fraud, wilful misuse, unauthorised scanning, or any attempt to compromise or abuse the platform — in which case immediate suspension or termination may occur without prior notice and without any obligation of refund.

Changes to terms

We reserve the right to modify these Terms at any time. You will be informed by email at least 30 days before any material change takes effect. If you do not accept the revised conditions, you may terminate your subscription without penalty before the effective date of the new version. Continued use of the service after the effective date constitutes irrevocable acceptance of the updated Terms. All versions of these Terms are identified by a version number and date. The version in force at the time of your use governs your relationship with WatchScope.

Language and governing version

These Terms are provided in multiple languages for the convenience of users. In the event of any discrepancy, ambiguity or conflict between any translated version and the French version, the French version (Conditions Générales d’Utilisation) shall prevail and be deemed the authoritative text. Governing law and jurisdiction

These Terms are governed by and construed in accordance with French law, without regard to its conflict-of-law provisions. In the event of a dispute, the parties agree first to seek an amicable resolution in good faith. If no resolution is reached within thirty (30) days of written notice of the dispute, the commercially competent courts within the jurisdiction of WatchScope’s registered office shall have exclusive jurisdiction to settle any claim or dispute. As WatchScope operates exclusively in a B2B context, consumer protection rules — including any mandatory statutory rights applicable solely to consumers — are expressly excluded to the fullest extent permitted by applicable law.
